The Law and General Information applying to Terms and Conditions
These terms and conditions are governed by English Law. You and the Company both agree to submit to the exclusive jurisdiction of the English courts. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
These terms and conditions gives you information about the Company and the legal terms and conditions (Terms) which we (Learn to Drive) promote any of the services listed on our website to you, and you purchase driving lessons with a driving instructor (Instructors).
Information on our website may be changed periodically without notice. It is your responsibility to regularly check our website for any changes.

Please ensure that you read these Terms carefully, and check that the details on the Booking Form and in these Terms are complete and accurate, before you submit the Booking Form.
About you; The Pupil
Driving tuition is only available to you if you meet the following criteria:
Aged 17 or over, or aged 16 or over and in receipt of the higher rate of Disability Living Allowance (mobility component): and
Hold a valid United kingdom provisional driving licence; and
Be legally entitled to drive in the United Kingdom
Booking your lessons
Please ensure that you read these Terms, and check the details on your booking form are complete and accurate before you submit the booking form.
When you submit you’re booking form to us, this does not mean your booking for driving lessons has been accepted.
The terms and conditions will become binding when your instructor contacts you to confirm the date and time that your driving lessons will commence. It is at this time that the contract between you and your Instructor will come into existence.
If you cannot be supplied with driving lessons, we will inform you of this and we will not process your booking inquiry.
Your lessons will be taken in a manual vehicle unless an automatic is specifically requested at the time of the booking.
Unless specifically requested at the time of the booking, either a male or female Instructor will be provided for your lesson.
All lesson/s are off minimum of 2hrs unless otherwise agreed by your instructor.
If you have booked intensive or crash course for X amount of hrs and on the day you cancel without required 7 days notice you will be charged for all hrs agreed for that day and you will not be entitled for refund of remaining course where as block booking and standard lesson required 48hrs notice.
The Contract for your driving lessons is made solely between you and the Instructor (who is a Franchisee of Learn to Drive.). All financial transaction are between you and the instructor, including pre-paid lessons paid direct to us.
You and Your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons. You must keep the Driving Record up to date at all times.
You must notify your instructor of any matters which affect your ability or entitlement to have driving lessons, for example, but not limited to, any lack or loss of a valid UK provisional driving licence.
Prepaid Lesson(s) must be taken by you within 7 days of the contract being formed unless agreed by us or Your Instructor in writing. You will not be entitle to a refund after the expiry of this period.
Offers and Price Charges
Prices for standard single lessons vary, and are set out in our price list in force at the time that the booking is confirmed. Please contact us for the standard pricing structure.
Learn to Drive presents a great range of offers and discounts to new learner pupils on learning to drive. Learn to Drive reserves the right to introduce (and withdraw) special offers from time to time.
Special Offers are only available to pupils who have not booked their practical driving test prior to booking the Special Offer Lessons unless agreed otherwise with your Instructor.
If Pupils book their practical driving test prior to the last Special Offer Lesson we reserve the right to charge you the full price for the Lesson(s) after the booking.
Special Offers are conditional upon you having regular lessons and not having a break of more than 7 days between Lesson(s) unless agreed by Your Instructor or Us. Where a breakage of more than 7 days occurs we reserve the right to charge you the full price for any remaining Lesson(s) and/or withdraw any free Lesson(s) under the Special Offer. The remaining hrs or the course will not be refundable.
Price Changes
We reserve the right to change the price of all our lessons from time to time.
The cost of the prepaid tuition is based on the lesson price in force at the time of booking in, with the exception of the circumstances set out below will be honored for 7 days thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken.
Any unused lessons remaining after 7 days have elapsed shall have any lesson price increase applied prior to the lessons which shall become payable by you. You will not be entitled to a refund after the expiry of this period.
Circumstances where, if you have prepaid, you will be either be required to pay an additional amount beyond the cost of your pre-paid lessons (as applicable):
1. Where you have moved postcode area and requested reallocation to another instructor because your current instructor does not operate in the new postcode area, you will be required to cover any difference in the hourly rate between those instructors where your new instructor charges a higher hourly rate. An Administrative charge will apply.
2. Where you have requested to switch instructors within the same postcode area and your new instructor charges a higher hourly rate than your previous instructor, you will be required to pay the difference in the hourly rate, plus an administration charge. You will also forfeit any offer price given to you at the time of booking.
3. Where you have requested to switch instructors in the same postcode area and your new instructor charges a supplement (for example an additional fee for tuition in a car with automatic transmission), you will be required to pay any such supplement, plus an administration charge.
4. Where you have not undertaken any lessons for a period of 7 days and have been reallocated instructor after a price rise in tuition has taken place you will be required to pay the difference in price for your remaining lessons, plus an administration charge.
Payments and Lesson Bookings
Please note once a request and a payment has been made for a last minute DVSA driving test cancellation it is non-refundable. A partial refund is available if 3 days notice is given prior to test date.
You must pay for any lessons one week in advance following methods:(All lesson/s have to be paid in advance)
1. Payment by credit or debit card by telephoning Learn to Drive on 07886304061. A handling fee applied to credit card transactions . (This charge does not apply to payments made by debit card). A booking and administration fee of £10 will be charged in addition to the price of the Lesson(s) bookings made by card over the telephone.
2. By a validated Learn to Drive (Driving School voucher). Please note vouchers are valid until the date shown thereon. Voucher and gift cards have no cash value and have to be redeemed against lessons. Vouchers are not transferable once they have been redeemed.
3. Payment by cash or cheque direct to your instructor (any cheque must be made payable to your instructor).
Learn to Drive has no responsibility or liability to you for payments made by any other means. If you pay your instructor directly by any method, you should obtain a receipt. Learn to Drive accepts no responsibility for any payments made directly to instructors.
Once the booking has been made, we will forward your details to the Instructor who we assign to you. The instructor will contact you within 5 working days to confirm the date, time and location of your lessons, which is when these terms and conditions come into place.
If your Instructor or we book your practical driving test for you on your behalf, you must pay the cost of the test fee and admin fee to your Instructor or to us prior to the driving test being booked. This payment is in accordance with the driving Standard’s Agency Fee structure and is Non – Refundable, including if you cancel you’re driving test for any reason.
(please note on the day of your practical test to use the car and instructor fee is payable separate which starts from £150 and may vary depending on the test centre location )
Changes to your Lessons
If you wishes to change a lesson a minimum of 48 hours prior notice should be given. In the unlikely event that your instructor cancels a lesson your instructor shall rearrange the lesson when he/she next available.Changes by you must be made directly between you and your instructor.
If the Instructor needs to change a pre- booked lesson at short notice due to mechanical fault or breakdown of the vehicle or for any other personal reason your instructor will contact you and rearrange the lesson in their early next availability please insure our instructor are self employed and they are not obliged by law to attend you for the above reasons. If for any reason i.e traffic and weather condition we allow 20mins delay in your lesson which will then be covered.
We allow our instructor 15mins wait for the pupils and the lesson has to be rescheduled and you will be charged.
Please note that in the event of you having booked your driving test, the Driving Standards Agency (dvsa) stipulates that you need to give three clear working days to cancel your test. This may mean that you may/will lose your dvsa test fee if your instructor says you are not ready for test within this three day notice period.our instructor can refuse to take you for the test any time if they feel you are risk to them and other road user.(road safety act 1988)Please note if for any reason one of your regular instructor is not available for the test we reserve the right to send any other instructor and the car without notifying you to cover your test we accept no responsibility if you fail your test.
Transfer ability of lessons
You cannot sell or transfer lessons which have been purchased in your name to any other person.
Prevention of fraud
Your lessons are only valid if they are purchased through the channels outlined in the ‘Payments and lesson bookings’ section set out above. If your lessons have been purchased through another source please contact us immediately.
In the event that some or all of your lessons were not purchased in accordance with the foregoing terms, Learn to Drive reserve the right to suspend these lessons in your account, with immediate effect.
An investigation will then be conducted by Learn to Drive in order to check the validity of the purchase. Where the results of the investigation determine that the lessons are not valid they will not be provided to you and Learn to Drive shall have no liability in these circumstances.
Customer care
Your contract is between you and your Instructor (who is a franchisee of Learn to Drive)
For the avoidance of doubt all financial transactions are between you and the instructor including pre-paid lessons paid direct to us.
In the rare event of any problem arising, you should resolve this with your instructor in the first instance.
In the unlikely event that you are unable to reach a satisfactory conclusion, we will be happy to investigate further, following your initial contact to resolve the matter with the Instructor, until the matter is resolved. –
Please note that we will require evidence of any financial transactions and lesson times before we are able to investigate. Therefore, it is imperative that your Driver Record (provided to you by your instructor, upon request. and also via email at the time of a pre-paid booking) details are kept accurate and up to date to verify your claim.
We are unable to investigate any matter on your behalf without an up to date Driver Record or receipt.

Complaints procedure
If you have any concerns or complaints about any part of your driving tuition which cannot be resolved with your instructor, please contact the Customer Service Centre within 7 days in writting to our office at: 77 RABY ST, TINSLEY, SHEFFIELD, SOUTH YORKSHIRE. S9 1SQ UK.
Where the Customer Service Centre is unable to resolve your complaint to your satisfaction, you will be entitled to escalate the matter to Our Customer Services Department by writing to Customer Services at the address shown above.
The Customer Care team will use reasonable endeavours to respond to your written query within 7 to 14 working days.
Refund Policy and Procedure
We reserve the right to change prices any time without giving prior notice.
Please note there will be a £40 admin charge on all refunds.
If you don’t want to carry on any paid hourly and block booking packages and you not started your lesson yet, you can claim refund within 7 days. After this period, no refund will be given.(please note if you have booked through third party i.e. online companies and not through (learn to drive)you will not be eligible for refund whether you have started or not)Please note above does not apply to any crash or intense courses booked through us or third parties , companies they are non refundable.
For all courses booked through online companies you will be only allowed to sit in practical test once thereafter you have to pay for the dvsa test and admin fee to re book the test again through our self . And to use the car and instructors service on the day of the test if you fail first time again £150 for local test center and may vary if test center is out of town payable separate.
If we are Unable to find an Instructor for you, we will inform you within 14 days and refund the money into your account.
If you paid directly to Instructor, you contact your Instructor for a refund. Your contract is between you and your Instructor. However any issues should be reported back to the customer Services team within 7 days at: 77 RABY ST, TINSLEY, SHEFFIELD, SOUTH YORKSHIRE. S9 1SQ UK.
Cancellation of booking for any lesson(s) should be reported 48hrs prior to your lesson,(Three working days for practical test and Seven working days for your crash or intensive courses) otherwise you will will be charged the agreed fee or hrs. should lessons be cancelled outside of the 7 days and lessons have begun no refund will be issued for the remaining hrs or for the total hrs booked.
1. If you have taken lesson(s) at the time of cancellation you will not be eligible for a refund on any lessons taken and remaining hrs if you decided not to carry on with your driving lessons.
2. Part refunds are the responsibility of Your Instructor once lessons have commenced.
3. Where it is possible to do so on exceptional circumstances we will refund you using the same method you used to pay for your lessons when you made the payment. If for any reason we are unable to do this, we reserve the right to refund you by any other method we deem appropriate.
4. We may request additional information from you to confirm your identity in order to comply with the Money Laundering Regulations 2007; we will also use this information to ensure adherence to our Merchant Operating Instructions for card collection facilities.
5. Refund of block booking will only be given if you claim refund with in seven days of your booking and not started your lesson yet.
6. In the event of a offer price or block booking packages where you have not paid our full hourly rate for manual or automatic car no refund will take place for the remaining or total hrs if you wish to discontinue for any reasons and seven days refund policy will not apply.
7. If you have paid using a prepaid Learn to Drive gift voucher, we will not be able to proceed to any refund after redemption of the card or voucher.
8.There will be no refund if you book us just for your last minute test or (covering your just quick test)which is called last minute test.If you change mind just you found some one else cheaper.
If you have paid your instructor for the tuition you wish to cancel, your instructor will refund you adhering to the same principles as set out above. In all Instances, You should contact your Instructor for a refund.
Limitation of liability
Your instructor and Learn to Drive are not liable to you for any loss or damage caused where, and to the extent that:
There is no breach of a legal duty owed to you by the relevant person or body;
such loss or damage is not a reasonably foreseeable result of such a breach;
any such loss or damage, or increase in the same, results from any breach or omission by you
any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body.
Your instructor and Learn to Drive shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, lost earnings, loss of opportunity or business or business interruption.
You are reminded that Learn to Drive are not parties to the contract for driving tuition itself, which is between you and your instructor, who is a Franchisee of Learn to Drive . This does not affect any liability that Learn to Drive may have for any loss or damage you may incur which is caused directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to you.
Nothing in these terms and conditions will affect any statutory rights you may have as a consumer.
Collection and use of data
Any personal data you provide will be held securely and in accordance with the Data Protection Act 1998.
We will use your personal data for the purpose(s) for which you have provided it. It may also be used for marketing, research and statistical purposes and crime prevention.
We may however need to disclose personal data to a third party so that the service you requested could be provided. It may also be necessary to transfer it to countries outside the European Economic Area. Where this happens, we will endeavor to ensure that any recipient of your data will treat it with the same level of protection as we would.
Your data may be disclosed to regulatory bodies for the purposes of monitoring and/or enforcing compliance with any regulatory rules/codes. If you give us information about another person, in doing so you confirm that they have given you permission to provide it to us to be able to process their personal data (including any sensitive personal data) and also that you have told them who we are and what we will use their data for, as set out in this notice.
In the case of personal data, with limited exceptions, you have the right to access and if necessary rectify information held about you by formal written application to Learn to Drive 77 RABY ST, TINSLEY, SHEFFIELD, SOUTH YORKSHIRE. S9 1SQ UK.
By providing us with your personal data and contact details, you consent to the use of that data and to your being contacted by any Learn to Drive member by post, telephone, email, SMS or other electronic means, to inform you about products and services which it considers may be of interest to you. However you can contact Learn to Drive in writing at any time to suppress some or all Learn to Drive products.
Your calls to the Sales and Customer Service Centre may be recorded for quality monitoring and training purposes.
